WaterHub - Conditions Of Access

To access the WaterHub, or any of its modules, users must agree to be bound by the following conditions.

1. In these conditions WaterHub refers to the database system, or any module therein, which has been created by the SEQWATER to facilitate the operation of the South East Queensland water market (the Market) established under the Water Act 2000 (Qld) (the Act); and
2. SEQWATER provides the user with a licence to access and use the WaterHub, on the conditions set out here. The licence may be revoked at any time by SEQWATER.
3. The user acknowledges that the WaterHub is the property of SEQWATER and this licence transfers no ownership rights. Access to the WaterHub is provided solely to facilitate the operation of the Market or to achieve the purposes of Chapter 2A of the Act, and the user must not access or use the WaterHub for any other purpose.
4. The user may only use, reproduce or modify the information contained in the WaterHub where necessary to comply with the Market rules established under the Act or as authorised in writing by SEQWATER.
5. SEQWATER provides no warranties regarding WaterHub, the WaterHub or the information stored in either, including, without limitation, any warranties as to:
   1. the level of performance, functionality or availability of WaterHub or any module; or
   2. the accuracy, completeness or suitability of the information stored in WaterHub or any Module. That information is provided by third parties. SEQWATER will take no steps to verify that information. Accordingly the use of or reliance on that information is at the user's own risk.
6. Neither SEQWATER nor any of its officers, employees, advisers, contractors or agents will be liable to the user for any loss incurred as a consequence of use of the WaterHub or any loss arising from:
   1. any defect in or failure of the WaterHub or any delay in the user's ability to access or use the WaterHub; or
   2. any loss, inaccuracy or inadequacy of the information stored in the WaterHub, however caused.
7. If personal information is submitted to the WaterHub or to SEQWATER in order to access the WaterHub (such as your contact or employment details), this information may be stored in the WaterHub and SEQWATER and other persons may use or have access to this information for the purpose of facilitating the operation of the Market or to achieve the purposes of Chapter 2A of the Act, including the auditing of information stored in the WaterHub. The user is responsible for obtaining any necessary consent to the use of this information.
